1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of MyCustodyCoach ("Service," "Platform," "we," "us," or "our"), an AI-powered legal assistance platform provided by MyCustodyCoach, LLC. By accessing, using, or creating an account with our Service, you ("User," "you," or "your") agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these terms, do not use our service. Your continued use of the service constitutes acceptance of any changes to these terms.

2. Critical AI and Legal Disclaimers

2.1 No Attorney-Client Relationship

MyCustodyCoach does not provide legal advice and does not create an attorney-client relationship. We are not a law firm, and our Service does not constitute the practice of law. All content, responses, and guidance provided through our AI system are for informational and educational purposes only.

2.2 AI System Limitations

Our Service utilizes artificial intelligence technology that, while sophisticated, has inherent limitations:

  • Accuracy: AI responses may contain errors, inaccuracies, or outdated information
  • Context: AI cannot fully understand the nuanced complexities of your specific legal situation
  • Legal Standards: AI responses may not reflect current law or jurisdiction-specific requirements
  • Professional Judgment: AI cannot replace the professional judgment of a qualified attorney

2.3 Mandatory Professional Review

You must have all AI-generated content reviewed by a qualified attorney before using it in any legal proceeding. Failure to obtain proper legal counsel may result in adverse legal consequences for which we bear no responsibility.

2.4 Jurisdiction-Specific Disclaimers

Family law varies significantly across all 50 U.S. states and territories. Our Service provides general guidance but cannot account for all local laws, court rules, or procedural requirements specific to your jurisdiction.

3. Acceptable Use Policy

3.1 Permitted Uses

You may use our Service only for:

  • Educational and informational purposes related to family law
  • Document analysis and understanding
  • Preparation assistance for legal consultations
  • Personal organization of custody-related information

3.2 Prohibited Uses

You agree NOT to use our Service for:

  • Obtaining legal advice or representation
  • Filing legal documents without attorney review
  • Making legal decisions based solely on AI responses
  • Emergency situations requiring immediate legal intervention
  • Any illegal, fraudulent, or malicious activities
  • Uploading false, misleading, or fabricated information
  • Attempting to circumvent usage limitations or security measures
  • Sharing your account credentials with unauthorized parties

3.3 Content Standards

All content you upload must be truthful, accurate, and legally obtained. You may not upload content that violates privacy rights, court orders, or applicable laws.

4. Data Retention and Deletion Policies

4.1 Data Retention Periods

Users can completely delete all of their data anytime in the Settings tab. Should they cancel their subscription without deleting, here's what happens to their data:

  • Account Data: 30 days after cancellation
  • Document Uploads: 30 days after cancellation
  • AI Conversation Logs: 30 days after cancellation
  • Payment Information: 30 days after cancellation
  • Security Logs: 30 days after cancellation

4.2 Account Deletion Rights

You may request complete account deletion by contactingprivacy@mycustodycoach.com. Upon verification, we will permanently delete all your personal data within 30 days, except where retention is required by law.

4.3 Data Portability

You have the right to receive a copy of your personal data in a structured, machine-readable format upon request.

5. Limitation of Liability

Critical Liability Limitations

To the maximum extent permitted by law, MyCustodyCoach shall not be liable for:

  • Legal Outcomes: Any adverse results in custody proceedings, court decisions, or legal matters
  • AI Errors: Inaccurate, incomplete, or misleading AI-generated content
  • Missed Deadlines: Legal deadlines, filing requirements, or time-sensitive obligations
  • Data Loss: Loss, corruption, or unauthorized access to your data
  • Third-Party Actions: Actions taken by opposing parties, courts, or legal professionals
  • Consequential Damages: Lost custody time, emotional distress, legal fees, or other indirect damages
  • Service Interruptions: Temporary unavailability or technical issues

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

6. Indemnification

You agree to indemnify, defend, and hold harmless MyCustodyCoach, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of our Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you upload or submit to our Service
  • Any legal decisions made based on AI-generated content
  • Your failure to obtain appropriate legal counsel

7. Force Majeure

We shall not be liable for any delay or failure to perform our obligations under these Terms due to circumstances beyond our reasonable control, including:

  • Natural disasters, pandemics, or public health emergencies
  • Government actions, regulations, or legal requirements
  • Internet service provider failures or cyber attacks
  • Third-party service disruptions (including AI providers)
  • Labor disputes or supply chain interruptions

In such events, we will make reasonable efforts to restore service and notify users of significant disruptions.

8. Subscription and Payment Terms

8.1 Subscription Plans

Our Service is offered through various subscription plans with different features and usage limits. Plan details and pricing are available on our website.

8.2 Payment Terms

  • All fees are charged in advance and are non-refundable unless required by law
  • Subscriptions automatically renew unless cancelled before the renewal date
  • Price changes will be communicated 30 days in advance
  • Failed payments may result in service suspension

8.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.

9. Intellectual Property

9.1 Our Rights

MyCustodyCoach and its content, features, and functionality are owned by MyCustodyCoach, LLC and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

9.2 Your Rights

You retain ownership of any documents, text, or other content you upload to our Service. You grant us a limited license to process and analyze your content to provide our Service.

9.3 AI-Generated Content

You may use AI-generated content for your personal legal matters, but you may not redistribute, republish, or use such content to create competing services.

10. Governing Law and Jurisdiction

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles.

10.2 Jurisdiction and Venue

Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Colorado, and the parties consent to the jurisdiction of such courts.

10.3 Multi-State Recognition

While we serve users across all 50 U.S. states, users must comply with their local jurisdiction's laws regarding the use of legal technology services.

11. Arbitration and Dispute Resolution

11.1 Binding Arbitration

Any dispute arising out of or relating to these Terms or our Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules.

11.2 Class Action Waiver

You waive any right to participate in class-action lawsuits or class-wide arbitration against MyCustodyCoach.

11.3 Exceptions

Either party may seek injunctive relief in court to protect intellectual property rights or prevent irreparable harm.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email and prominent website notice at least 30 days before the changes take effect. Continued use of our Service after changes constitutes acceptance of the new Terms.

13. Severability and Entire Agreement

13.1 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

13.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyCustodyCoach regarding your use of our Service.
